I represent the **** iowa in a disability discrimination case where the plaintiff, a former employee, suffers from asthma triggered by fragrances. The **** does not dispute the existence of the asthma or the trigger effect of fragrances. However, the **** does believe that expert testimony is necessary to inform the jury that (1) there are so many potential triggers in the environment, and the plaintiff has become so sensitized to them, that she will be suffering from frequent and regular asthma attack for the remainder of her working life and (2) it is impossible to place the blame for any one asthma attack on any one trigger without some sort of testing (which was never done).
